As you are talking about a past event it would be correct to use the past form of the modal verb as well. Have a nice week. |

Definitely : Peter shouldn �t have been punished. Remember that present perfect is used to link past and present. Shouldn �t be is in present and can �t be used in situations that are in a past time frame, such as YESTERDAY. Plus this situation refers to PASSIVE VOICE (Peter didn�t do anything - he just "receives " the action)
